the case has to have merit. look at it this way.. would yrc and the ibt enter into illegal agreements? YRC and the IBT KNEW that the concessions approved well over a year ago put ABF at a big cost disadvantage. You don't think it occurred to either party that ABF would sue their pants off if they could? And why did ABF continue to lose TENS OF MILLIONS for the last year, and only say something after YRC was allowed to continue the concessions? NO WAY, NO HOW is YRC liable in this case. And no way a federal judge can impose wage concessions on the teamsters involved ( abf teamsters). They said NO! The wildest possible scenario is that a federal judge in Arkansas rules that ABF is not bound to any part of the NMFA. Essentially throwing out the union and its contract. And then all HAIL would break loose.
