I guess the attorneys are in the same boat as everybody else. I can't imagine what is holding this up. The discovery end date is November 30, 2012, and there are discovery motions pending as well as a bunch of other motions. The Markman hearing was on August 6 and the judge appointed the technical expert on September 10, 2012, so enough time has passed to decide this.
My experience in the law is that you never know when something like this is going to happen - you just know that sooner or later it will happen. I expect that the judge may well decide everything all at once- the Markman ruling- order on the discovery motions - and maybe even some of the other motions. I fully expect a favorable Markman ruling - a massive short squeeze- and this case settling. Stay tuned.
You post "my experience in the law is that you never know when something like this is going to happen" YET on 10/12/12 you posted "The fact of the matter is that the Markman ruling will be out by Monday morning" Seems like you talk (post) out of both sides of your mouth and we can't really rely on your posts because they are sometimes contradictory to other of your posts.
I know you are joking, but, of course, the judge will not time the release of his Markman ruling to coincide with the PRKR quarterly CC. I do not expect any material news regarding the case or other matters tomorrow.
