    Could both Apple AND Google end up with the patents?

    When the topic of selling the patents came up last Summer, AP had a "Town Hall" meeting and pointed to the Nortel and MOT activity, saying the time was right to sell a select portion of EK's extensive portfolio of patents.

    One audience member asked if we would end up paying royalties to someone else for patents "we" had.

    AP said that under the terms of the patent sale, EK would still retain the right to use them.

    Now, what happens if the patent sale garners enough cash to pay the creditors, get the house in order, and emerge from BK. Let's say Google's team won the patents... And Apple turns around and buys Kodak?

    Would both now have legal rights to use the patents?
