The Circuit Court of Appeals has given Mattel a break and voided the unfair competition claim against Mattel. I am really hoping that this puts this to an end. This has cost at least $300 million in legal fees (if you include the fees that Mattel has to pay of Bratz), and may have cost the prior ceo his job. I know that this was litigious, but after Mattel won the prior case (and before reversal) they should have settled. It may have had the side benefit of reinvigorated Barbie sales, but came at a real cost (probably $1 per share). Mattel won't build a US plant and pay US workers $15/hr, but will spend lots of money on lawyers at rates as much as $1000/hr (and I am a shareholder and a lawyer).
I hope that this is really ended. If Bratz starts a new action against Mattel, they should throw them some money and settle it.
