    (CASP 321) New ON2 info to the previous owners of ON2 Technologies

     

    Just received a notice from judge Grays Court; From the Notice:
    PLEASE TAKE NOTICE that the within is a true and correct copy of the Order and Decision of the Honorable Marguerite A. Grays, dated July 20, 2012 and entered on July 25, 2012 in the office of the Clerk of the County of Queens, rejecting the proposed settlement of this action as a non opt-out class action pursuant to rule 908 of the New York Civil Practice Law and Rules

    (rejecting the proposed settlement of this action as a non opt-out class action) So opt out and future individual suits are possible for those that chose to opt-out of the agreement.

    (7). The Settling Parties may, in their sole discretion, elect to submit for Court approval a revised Settlement Stipulation which contains the same terms and conditions as the Settle Stipulation but provides for certification of a Settlement Class that affords proposed class members who are non-residents of New York State the right, consistent with the terms of paragraph 6 hereof, to opt out of the settlement Class and the proposed settlement (the revised Settlement Stipulation). If the Settling Parties submit such a Revised Settlement Stipulation, then the Court will (a) require the Settling Parties to provide appropriate notice of the Revised Settlement Stipulation to proposed class members, and (b) upon proof of such notice, approve the revised Settlement Stipulation.

      Here is what I think is happening and why this judge will not be able to wash Google clean after all:

      I think HONOURABLE Federal Magistrate Judge F. Bradford Stillman, the judge in Vringo-vs-Google-AOL-..., prefered to RULE Markman as he saw the case and retire instead of being uncertain about who or how they might pull his leg before Vringo vs Google complelete its course!

      No one want to retire that early especially with these coming from Media "that Stillman has no plans for retirement." I should say thanks, many thanks to this judge possibly knowing that it's not easy to maintain the same position when one is swimming against the current.

      ON2's judge screwed up by letting a "lead-plintiff-with-100-ONT-share" make $450,000 for his counsels but nothing for himself, as they want you believe, and causing a huge damage to ON2 shareholders, and might be in trouble down the road once another case like ON2 bring more attention to her ruling?

      Oracle's judge tried to make it look better after he ruled against Oracle by asking Google and Oracle to provide the court names of those reporters, "experts", ... under their payroll writing favouable articles about Google or Oracle that might've had negative effect on his ruling, but later on quietly called it quit and "complete?

      Vringo's judge retires less than two working weeks of Vringo vs Google trial starting on October 16, 2012, and here is the "reasons":

      US Magistrate Judge Stillman to Retire

      January 28, 2012
      Hislast day will be Sept. 30.
      The Virginian-Pilot reports that Stillman has no plans for retirement other than to enjoy his family.
