The Judge granted MNTA’s Motion for expedited discovery relating to…

...certain sections of Amphastar’s ANDA, and Amphastar has been ordered to produce the documents on or before Oct 17:

This is, of course, excellent news for MNTA.

      The Consortium

    • Clarke,kmjokers, and others,

      Yesterday PI was issued.

Please see how wrong the Consortium was in it's original prediction that a settlement will happen before PI.

This is one of 10k predictions(disguised as statements of fact) by the Consortium that went kaput.

    • You are waisting your time and money. Get out for good before you lose everything.

      It will happen you know.

See how THE CONSORTIUM is wrong. Consortium initially said it is HIGHLY LIKELY THERE WILL BE A SETTLEMENT BEFORE PI. I SCOFFED AT IT. TO WHICH THE CONSORTIUM SAID I DON'T KNOW WHAT I AM TALKING. WITHIN 10 DAYS, CONVENIENTLY CONSORTIUM HAS CHANGED POSITION WITHOUT ANY APOLOGY.

As I mentioned PI motion will be decided by court. THERE WILL BE NO SETTLEMENT TALK UNTIL PI MOTION IS DECIDED. IN FACT THE SETTLEMENT TALK IS VERY PREMATURE, AND ONLY WILL COME IN AFTER TRIAL HAS LASTED A WHILE AND EACH PARTY KNOWS IT'S LEGAL POSITION WELL.

      CONSORTIUM'S REPLY

Contrary to your assertion, a settlement between the parties can occur at any time. It is most likely to happen, IMO, after limited expedited discovery and before the ruling on a preliminary injunction, which is well before the start of a trial.

CONSORTIUM flips its position within a matter of 10 days:-)

Quote:If a settlement is going to occur, it's presumably going to be before the judge renders a decision, though, right?

I presume you’re talking about a Judge’s decision on whether to issue a PI. Originally, I thought that the period after limited expedited discovery and before the Judge’s decision on a PI (i.e. the period we are in now) was the most likely time for a settlement to occur; it (IMO) still is the most likely time for a settlement in terms of probability density. However, the period in question runs for only seven days, so the absolute probability of a settlement during this seven-day period is modest; if I had to put a number on it, I would say 15%.

I think the cumulative probability of a settlement at some point before the litigation has run its course remains high

    • Koberj is right?

Koberj is your other alias, of course you agree. Go ahead, deny it and I'll post the proof otherwise. On second thought, forget it, you're going on ignore, you're wasting my time.

    • Courtesy informing - given your repetition, shouting, ... worse than anything Dew has every done I will be ignoring any post in which you mention Dew directly or indirectly. Starting now and regardless of how intriguing the other content is. If you want feedback - ignore Dew

"Obviously there are numerous other people who say very authoritatively that 'for reason Z investment in Company Y is a sure thing'. Dew is not novel in that regard. "

Please read the below thread again. He is not just authoritative and misleads novice investors. In IHUB with his numerous cohorts and ids, he is THE JUDGE, JURY , EXECUTIONER.
On top of this, he is WRONG at least 50% of the time. And he doesn't point to those messages. He points to messages where he was right.

Koberj is right. The amount of disservice and harm he has done to investors by misleading, bullying, soothsaying and disguising falsehoods/speculations as truth is HUGE.
Many novice investors get burnt by individuals of this Consortium's kind. Worst of all, he has no morals to apologize to investors. He was the biggest bully with his 10k ids when somebody posted anything about Amphastar or Teva ANDA just 2 months back. Not a single apology was provided to investors on how wrong he was in his premise that nobody will be able to characterize Lovenox. I repeatedly told him HE HAS NOT READ TEVA'S OR AMPHASTAR'S ANDA (OTHER THAN HIGHLY SPECULATIVE) TO SAY THAT. I TOLD HIM INSTEAD TO READ THE PATENTS, UNDERSTAND THE FDA CRITERIA AND SEE IF IT IS POSSIBLE FOR ANOTHER COMPANY TO SATISFY THE CRITERIA WITHOUT INFRINGING ON THE PATENTS. HE DID NOT WANT TO DO THE HARD WORK THEN. NOW HE PROBABLY REALIZES THE VALUE OF WHAT I MENTIONED THEN WITH AMPHA PI LAWSUIT.

    • <<I would contend Dew has done much more harm than good to the small investor, many of whom are not savvy enough to recognize that on many occasions what he presents as factual statements are in fact complete WAG's - and DEAD wrong.>>

      1) Does he not get recognition for the large number of people who did not participate in, or at least were more cautious of, an investment in crappy company X because of his comments?

      2) Obviously there are numerous other people who say very authoritatively that 'for reason Z investment in Company Y is a sure thing'. Dew is not novel in that regard.

Altogether I think it is very unfair to single out Dew - especially since he does much more that 99% of rah, rah bulls who you are NOT chastising (by Dew providing well articulated bear case data for crappy companies). That said, perhaps what he could link some of the key disbelief posts (Biomaven, rkrw, ... write plenty of negative/disbelief posts which are articulate and useful) into his ReadMe list.

    • <<BTW have you figured what could be the motive of this consortium>>

No. Maybe the world will catch a break and DD will get hit by a bus one of these days. One can only hope.......one thing is for sure, it's insidious, this consortium

    • Investorhara,

      Are you sick or what?

The market fell big today and Momenta held better than many other bio stocks.
It held better than many tech stocks as well.

      Get a life,

      The Gunner
