    Is characterization patent enforceable?

    If there is a full launch by Watson, it seems to me that the argument for the enforcability of the(characterization prcess) claim by Momenta if it does not hold up will knock all the wind out of any patent claim for mCopaxone with Teva. Even though there has been no aproval for it, likewise with any other biosimilar they might come up with the original would win any patent suit up to expiration of said patent.

      Why would you say that without knowing which patents were allegedly infringed upon in the Enox case or where in the process the alleged infringement occurred.

      I am not sure what you are getting at with regards to mCopaxone and TEVA. Just whose claim would you think would have the wind knocked out of it. With regards to enox, neither Watson nor Momenta hold the original so it it was all about the original, then Sanofi would be holding all the legal cards.
