From the conference call...Peter Halt, CFO in response to the question, "...what portion of the 13 revenue guidence for is based on over the top video deals that ...are currently in litigation or are just unsigned deals at thsi point?"
Peter Halt, "We talked about it...we aren't putting the guidance in for the ones in litigation, those are ones that are upside to us..."
Tom Carson, CEO, " ...and some of the deals we have out there...the deals with the litigation we are in. We haven't included that in guidance, that's upside.... So there are things that aren't included that we look at very opportunistically and are optimistic about" He states these things could be 2013 or 2014 items.
Here are some of the firms that Rovi is in litigatin with, they have reached an agreement with Vizio and state that they could reach a deal with the others... that it is not a matter of patent violation... thjey agree Rovi has the patent... it's a matter of compensation, and Rovi wants to get paid what they believe the patent is worth and these companies do not want to pay that much... It sounds like these deals will get settled just a question of how much they will pay.

On May 1, 2012, Rovi Corporation, Rovi Guides, Inc., Rovi Technologies Corporation, Starsight Telecast, Inc., and United Video Properties, Inc.—all of Santa Clara, California—and Index Systems, Inc. of the British Virgin Islands (collectively, “Rovi”) filed a complaint requesting that the ITC commence an investigation pursuant to Section 337.
The complaint alleges that the following entities (collectively, the “Proposed Respondents”) unlawfully import into the U.S., sell for importation, and/or sell within the U.S. after importation certain products containing interactive program guide (IPG) technology and related features, including televisions and media players, that infringe one or more claims of U.S. Patent Nos. 6,701,523 (the ‘523 patent), 6,898,762 (the ‘762 patent), 7,065,709 (the ‘709 patent), 7,103,906 (the ‘906 patent), 7,225,455 (the ‘455 patent), 7,493,643 (the ‘643 patent), and 8,112,776 (the ‘776 patent) (collectively, the “asserted patents”):
