    " U.S. District Judge Carl Barbier has ruled that 4.1 million barrels were spilled, not the 4.9 million claimed by the government. The Clean Water Act sets the fine at $1,100 per barrel spilled, a figure that can rise to $4,300 if the court finds the spill was caused by “gross negligence.” On that schedule, the fine could be between $4.5 billion and $17.1 billion, depending on whether gross negligence is proved.

    BP is fighting the negligence charge and likely will appeal the ruling on the volume of oil spilled. Some legal experts say proving “gross negligence” is going to be legally challenging. "
