Did Penn National truly perform all the necessary due diligence required before obtaining an option on the Toledo “Love Canal “ site? This site has P.C.B.’s and arsenic contaminations stored on the site and has numerous use restrictions! According to the Governor of Ohio, the change of use of this site to a casino by Penn National could possibly cause the “covenant not to sue” issued by the Ohio EPA to be revoked!
What is the potential financial liability to Penn National if that would happen?
The ballot language is site specific. It lists the address and location of the site that could be used for the casino if the issue passes. No other site in N.W. Ohio could be used for a casino.
The Toledo Blade article of September 14, 2009 quoted a number of statements by Penn National and Brad White, (current owner of the property) which are simply false and are very easy to challenge.
