from IN RE: ISOLAGEN, INC. SECURITIES & DERIVATIVE LITIGATION No. 2:05-cv-04983-RB

"Defendant Macaluso added: “The results from the trial position us well to move into the final
phase of our clinical development process.” The press release concluded that the Company 30
anticipated that the Isolagen Process could be available in the United States as early as 2005. "

    Sound familiar?

” In the July 21 release, Defendant Macaluso concluded: “The start of the Phase III Pivotal Trials in July 2004 should allow Isolagen to file for our Biological License Application (“BLA”) as early as the first quarter
    of 2005.”

"During the relevant period, and with the Company’s stock trading at artificially
inflated prices, Defendants DeLape, Macaluso, Avignon, Boss, Marko and Tomz collectively 73
sold at least 2.4 million shares of their personally held Isolagen stock for gross proceeds of over
$15 million, as set forth in the following chart:"

    • What the heck does this have to do with AMPE today? Macaluso has sold no stock and pledged not to do so.

Second - Macaluso sold about 400K out of 3,000,000 share he owned. So he lost a huge amount of money. The others did sell much more of their stock.

Last, the settlement was made by the insurance company with no fault found. This is pasted below:

      EXTON, Pa., Sept. 25 /PRNewswire-FirstCall/ -- Isolagen(TM), Inc.
(Amex: ILE) announced today that it has reached an agreement in principle
to settle its securities class action lawsuit and its two derivative
actions against the Company and certain of its current and former officers
and directors (Civil Action Case No. 05-cv-04983-RB, Case No.
      06-cv-01302-RB and Case No. 08-cv-724-RB).

"We are pleased to have reached agreement in principle to resolve the
last of the securities class action and derivative action lawsuits," said
Declan Daly, President and CEO of Isolagen, Inc. "The Isolagen management
team continues to execute against its goals in an effort to positively
      advance the Company."

Payments for all settlements will be funded entirely by the Company's
liability insurance. Under the terms of the proposed settlements, a payment
will be made to the putative class in the securities action lawsuit. In the
two derivative action settlements, a payment will be made for plaintiffs'
attorney fees. In connection with the proposed settlement of the securities
class action, Isolagen is to receive a release of indemnification claims
asserted by the underwriters of certain securities offerings who were also
named as defendants in the lawsuit. Also, in connection with the above
proposed settlements, Isolagen is to receive a final payment of $500,000
from it liability insurance carrier for reimbursement of any and all
      current and future defense costs.

Macaluso did not run Isolagen. He was a major share holder and spokeperson.

The insurance company wanted to settle. End of story.

      • Oh, they settled. Well, that must mean they didn't do anything wrong.

Macaluso is playing this just like he played isolagen: strigngin together a bunch of half true press releases and making promises on clinical data that won;t come true.

Why did Zertane go from "about to be partnered" to essentially shelved?

Why has complete data from AMPION study not been released?

Why has visual acquity data on Optina phase 2 study not been released?

These are simple question that you don't have the answer to. I guess it's just easier to claim I'm distorting the facts. You've been warned.....

    • You and your bosses must be worried, very worried. This post is clearly a desperate attempt to reverse the positive trend or positive upcoming news. You are twisting the facts to deceive investors for your personal gain and at the same time you are putting millions of patients at risk. Shame on you, you and your likes are nothing more than low life, dirty, disgusting criminal stock manipulators and I hope some day you all get the severely punishment you deserve.

      Sentiment: Strong Buy

    • Anyone investing or rather gambling in bios is more than well aware that the FDA process is binary and the risk/reward ratio appropriate...

Similar to roulette, you can relatively play red/black or even/odd and not gain much, or you can roll wih number placements and attain multiples. A bio FDA hit can be numerous multiples of current PPS.
