It is interesting that terp is the only person who talks about the appeal that AAPL is going to file, but when asked what the grounds are for appeal are he ignores the discussion only to bring the appeal argument later.
boris, what is it that you don't understand about the appeal process? AAPL doesn't have to have a valid reason to appeal. They will appeal to the Fed circuit court and it will take 12 months or so to invalidate it. They don't have to have a good reason. They can appeal and they will have to wait until the court invalidates it. I agree, probably have no grounds to appeal. However, when the appeal goes to the Fed court, it will wait on the docket to review the appeal. I believe that's about a 12 month wait. In the meantime, VHC gets slaughtered because nobody is going to sit with dead money for another year.
Terp, the Fed. court of appeals does NOT have to hear the appeal, they can simply send it back as "unheard". It will only take a month or two. Apple needs a real reason to support a real appeal that will get anywhere, and they know it.

Well of course he does. He has nothing left in his quiver. He used to have a number of different "short" rationales but, one by one, they are all being invalidated in the fullness of time. His current fave, the Apple appeal, will suffer exactly the same fate as all the rest. He knows it, we know it, and what you hear from Terp is simply the pitiful sad mewlings of a short who knows he is totally f@@ked.
