Judge Davis is probably putting the finishing touches on the final ruling as we speak.So Apple has definetely been caught infringing. The jury thought $368 million was fair. It was a very clear cut case. Apple will probably appeal but if you have been following all the legals and trial information Apple doesnt seem to have any grounds for appeal. Dosent mean they cant drag this out a little longer. Judge will no doubt increase the award due to the latest data figures from Apple. Judge is also contemplating an injunction on vhc technology and may ask Apple to implement their workaround and or remove VHC technology That would be disastrous for Apple since their workaround is a joke and sets them back 10 years just as others are catching up and passing them by. Apple can not afford any more bad news. MSFT trial played out similar to this and Msft never went through with the appeal. Smarter heads prevailed there. We could wake up Monday morning to a final ruling and who knows where the pps could go. That kind of news should put $10 on the pps. In my mind How strong the shorts are will determine the move. How many conversions can they do , a lot I am sure but not $10 worth,we shall see I am sure. Havent even mentioned the cisco fiasco about to unfold,thats anothe topic...
We could wake up Monday...then again maybe not, probably just another NEXT Monday. A few more "milestone" dates have come and gone in the past week or so. IF, and that's a big if, we get some positive substantive news, the only thing the shorts will determine is how high it goes when they cover. I mean, really, what's the good judge's hangup. The average "hot stock" "investors" are moving on. This "story" is old and moldy to the average MB speculator.
