Cisco's principal witness on infringement has been disqualified from testifying! The patent in question is therefore not being effectively challenged at all as to validity. Cisco was doing rather poorly before today but the case just went totally down the tubes.

Judge Davis has not allowed Dr Alexander to testify on Altiga as prior art due to his "inadvertent" substitution of a later product line for the Altiga system. The '759 patent has therefore not had any invalidity arguments against it whatsoever.
Beyond the obvious significance of the above, Cisco's case appears to be falling apart at the seams in my opinion. The credibility of any individual component of their arguments is serving to call into question the integrity of their overall defense, and ultimately that is a crucial factor that the jury will consider.
