At least for the short term. The only possible reason for an upward move would be some positive news on the Apple case, of course the judge could over rule the jury's verdict in the Cisco case but can you really buy on that outcome? Couple that with the overhang created by yesterday's and todays volume and there doesn't seem to be much chance for it to rally while there appears to be a better than even chance that negative developements in the Apple case could pound this lower and with nothing positive on the immediate horizon another leg down seems inevitable.
I can't say that won't happen because,well, anything can happen but what would be the rational to buy?It has been said ad nauseum but is still true,"if their patents are so vital,necessary,or required why hasn't it happened?" If they had a whole raft load of agreements and millions coming in annually then I could see it, but not now, the entire industry is steaming ahead and the obvious feeling towards Virnetx is a collective so what. MS settled with them with about a week to go before the judge gave his final ruling. The only thing right now worth hoping for is that they settle with Apple and I believe their bargaining position has now been significantly reduced primarily because the have to start generating income soon and if Apple appeals it will be a long time before they see a penny.
