I don't think Judge Davis will make a ruling on a 1)Cisco new trial or 2) a RR regarding Apple until after a few weeks at least.
Monday's hearing can take one of two forms.
1) Let VHC try to pursuade Judge Davis that a new trial is warranted and consider Cisco's response. Cisco's reply to a new trial is weak as has been indicated in a previous post. or
2) He may have issues he personally wants addressed and clarified. He would be proactive in the issue
I would much prefer 2 above. In any event Monday's hearing should be very insightful and give more than a hint on the judge's feelings on the matter.
RR regarding Apple
The judge, I think, will wait for Apple's appeal, due in the next two weeks, before issuing a RR ruling. This for several reasons including not giving Apple any further fodder to include in the appeal and allowing the judge to consider Apples legal position before ruling.
Of course they can. You are stating the obvious. However, there may be more information from Apple regarding their appeal that the judge may prefer to know before issuing his ruling.
The judge is also not holding up any timelines by delaying his decision 2-3 weeks.
