auggie, for 4 years KL assured shareholders a lot of things. He hasn't produced on any of them. He even lost a slam dunk CSCO case. This guy doesn't produce and I don't give him any chance of getting this company off the ground.
It is actually $72M that is keeping VHC from the NYSE.. And KL thinks that if they get a good ruling form the CAFC then have the extra cash is be easy to come by. That is what was said. I do not think he used the word "assures". He is too smart to use a word like that on the outcome of a court ruling. I do not think the judges would like to hear him say such a thing. Just not smart. And KL is not stupid. Just IMO
Glad Kendall is confident, but we all know there is a chance for a partial remand for new trial on damages, etc. Also, while I hope a ruling comes ASAP, I think we will be waiting until September or even mid October, and the stock will not have any direction until a ruling comes.
Would you care to be more specific on why you think the ruling will be so long in coming. I am not a lawyer but from all I have fead from those who are and others familiar with this court the amount of time seems to be 3 months. Which would make it about June 3-9. You are adding another 3 months . Curious as to why you think this. Frankly I do not see that it would need that much time (3 months) but am sure they had cases previous to this one.
agua, I'm certain the fact that VHC attorneys understood the importance of the Motorola reference and what that means for VHC is paramount in the scheme of the decisions about to be handed out by CAFC. Very positive outcome expected!!!
