Yesterday USAA filed "Motion to Exclude Mr. Reed's Opinions on Patent Infringement Damages". This must be Mitek's expert. I think it is a good thing that USAA is arguing about "damages" as opposed to "liability".

No idea. Keep in mind the filings are not done tomorrow when they are due. Each side will respond to the others msj and then each side will reply to the response. Figure another month for the additional filings. Judges can take their sweet time to issue a ruling, and often do, however in this case I think the Judge will rule fairly quickly given the September trial date.
