They will not become a REIT anytime soon. They have about $500 million carry forward losses. If they become a REIT, they can't use the losses.
They are not going to pay a divy anytime soon. They will reinvest the capital in the company. Earnings will go up, and share price will follow.
The litigation settlement does not end all lawsuits. However, I got the impression the remaining lawsuits are manageable.
They didn't give any forward guidance, but Joe sounded very optimistic.

also mentioned was the fact that they could pay a dividend on the common if they wanted to , the preferred holders voted away their rights a few years back !
