They are not going to file a 10K until AFTER they announce a bankruptcy, pre-pack bankruptcy plan, asset sale or whatever they are going to do. A 10K needs to have all sorts of disclosures about investor risk and can be grounds for lawsuits. There is no way their lawyers are going to let them file the 10K until the risk are clarified by doing whatever they are going to do.
Moneyartist is incorrect however, Assuming they declare bankruptcy and are delisted, they will still file a 10k. For example DEXO files for a pre-pack bankruptcy yesterday and then came out with a 10K. Of course that's a whole different situation than GMXR in that the stock rallied after the pre-pack filing and that's not going o happen here.
