Per the Court's website - general info, rules - the 90 days is mandated by their internal operating procedures. To miss it is a big deal and I doubt taken lightly. It's clear to me that their is dissension amongth the judges and that the decision will not be a simple reversal or affirmation. One would think that this favors PIP; however, it is possible that the court will through out the whole concept of "negotiation in bad faith"
There has been a delay..just got some info from the court. Due to the absence of the chief judge at oral arguments, the date the matter is deemed to have been heard is March 5...that is the date he listened to the recorded oral argument. Probably means another 30-60 days from today
Mine says reversal of the original verdict or at least significant decrease in judgement amount. But I own SIGA stock. Yours might say add an additional 100 million judgement in PIP's favor. Crystal balls can be manipulated that way.
I formerly owned 10,000 shares of Siga . . . lost my shirt on it. Now long and heavy in PIP. There is an appeal and cross-appeals for the Supremes to deal with. There are 5 justices trying to figure out a majority position. There could be concurring opinions and/or dissenting opinions. Who knows? I think it comes down to whether Parsons abused his discretion in fashioning the remedy. Any way you cut it, it will not be as long as it has been.
