Hey shorts and other idiots, just keep dreaming this is going to be your big paycheck! The only way Vringo
looses is both patents are invalidated completely not parts but 100% invalidated. the "420 and 664" recieve a complete notice of invalidation by the USPTO. This action brought against Vringo may take years to investigate but the ruling by JJ will stand regardless.
Here's the best part: Google requested re-examination in March of this year. Even if every single card falls exactly as Mr. Ravicher wants it to, Vringo has the right to royalties until the USPTO issues a final ruling on both the '420 and '664 patents.
Now look at how many patents have ever been invalidated... 1 to 2% in history. It would take every bit of all language in both patents to be invalidated and deemed a patent office error in order for Google to win. If any portion is valid Google looses.
Keep shorting you idiots!
And even with a win in court and expectations of up to 7% royalty rate the stock is still below the Apr 2 closing price after Altucher's article. Must be some sort of conspiracy against the longs... no other explanation.
Sure everyone is betting on the big company to win. Every day pressure mounts on the entire case and the judges final ruling. Fortunatly the ruling will not be delayed for the re-examinnation. The first and most crucial hinge point for Vringo investors now is a favorable ruling. That event alone should set the tone for Vringo's future and shareholders alike. Both sides want it all w/o any consessions. It only takes a percentage of what Vringo's asked for to see immediate results in confidence. Dating all the way back to Markman, Vringo has staged win after win regardless of Googles motions for everything under the sun. If JJ has not been illegaly influenced and has followed this case like everyone else has the only just and fair ruling must be in favor of Vringo. He doesn't get the luxory of just stating a ruling w/o explanation. So regardless, he will have to justify every decision along with verbal reasoning and that's pretty hard to hide behind. To deny Vringo's infringement charges against Google et al with all we've seen unfold up to now would literally mean he was asleep at the bench, woke up and found no charge against Google.
Not if but when he rules this will either FLY or DIE at that moment! Then it will continue to either go up or down from there period!
