I am not confident that mediation will yield an agreement. This situation with Macy's-Martha Stewart-JCP is no longer purely business. It has become somewhat personal.
Macy's CEO hangs up on Martha and has not spoken to her since her phone call to him. She calls him at home the evening before the JCP announcement is going to be released...classy. RJ's smug, gloating emails and testimony make the situation more personal.
As retay said, "she's not what it's going to take to save JCPenney..." Macy's CEO wants to stick to Martha and to RJ. My favorite RJ quote from the testimony: He Never Bothered to Read Martha's Contract With Macy's! Genius at its best!!
I'm just looking for 50 cents or a dollar - - - - my personal thoughts re: Martha Stewart suit - they are going to work something out in mediation that won't be worth a hoot or holler to anybody - - - I don't think any of them wants to take a chance on pizzing off the judge by dragging this back into court - - I get the feeling he doesn't think this belongs in his court room.
Let's face it - - - the judge rules in Macy's favor - they've won what they already have - - - -the judge rules in JCPenney's favor- they get the Martha Stewart line(stand alone shop or non branded) - - - big friggin whoop di do - - - that'll do even less for JCPenney than Joe Fresh - - - - Martha loses either way - - Macy's throws her out if Penney's wins - - she's not what it's going to take to save JCPenney so when they BK she loses - - - - if any of them are smart they'll make the best of a bad situation and take what they can salvage.
