    I believe patents are awarded for 17 years. The problem is you usually get it upon your "discovery" or "invention". The time you blow to develop a product, get and get it out to market, eats up patent time. They may very well have only 5 years left. The other thing is you can get a patent on "item" and on "use". Item would be if they synthesized the omega 3 and 6 oils - the strongest patent. They obviously did not - they have a "use" patent. They got a patent to use a blend of oils in foods. The issue is someone else can use a different blend, or get the omega acids from other materials - example is fish or other plants, or even another ratio of omega 3 to 6 if an effect on blood fat levels is proven different.

    The SMBL patents are not strong, someone can make very parallel products using other sources of the omega 3 and 6 fats. Actually, they infringed upon Johnson and Johnson whose McNeil Consumer products group did research on sterols to reduce blood fats and developed "Benecol" in the late 1980's

    Their game will need to be great marketing, good tasting products, reasonable prices, and above all - the one they consistently are missing - excellence in execution!
