This drug/stent is not what BSX has claimed it to be. Both the cardiologists and the FDA (and the courts) will make this loser painfully obvious over time. Just be patient steel. Of course the real fun will begin after April 5, if (admittedly a long (but possible) shot in the 15-25% range) the Federal Appeals Court overturns the ruling of the Judge in Wilmington and issues a preliminary injunction to immediately remove Taxus from the shelves. This really could happen. This same set of federal judges slapped the Judge silly when she tried to overturn the jury results in the Palmaz and Schatz rulings in the MDT case (i.e., they are very pro patent and very pro Palmaz and Schatz/JNJ). They may be appalled at the blatant and willful infringement of these rock solid patents and slap BSX down hard. That would mean bye bye to Taxus and BSX share price (would drop $20-25 in one day)!! Have fun longs. Good luck. You will need it. Even without injunction today, it will happen by the end of '05 with massive damages against BSX. BSX may actually be better off if the federal court takes them off the market now!

JnJ waited several years to bring action to enforce this patent -- this failure to act completely destroys any argument they have of immediate and irreperable harm.
Therefore, the standards for granting a preliminary injunction have not been met. Those standards are extremely rigorous, and for very good reason.
Those standards will be set even higher and will be harder to satisfy in the appeal because: i) the clear value of DES to the public health will be considered; ii) JnJ's has had nine months of monopoly and to work on it and STILL cannot satisfy market demand for the devices; and iii) the standard for appellate review is ALWAYS higher than the standard in the court of first instance -- its has to be shown that the lower court judge has made a clear obvious error of law. Since the law for Prelim. Injunctions is well established and was directly quoted by the lower court judge, there is zero basis for overturning the ruling.
In conclusion, if it couldn't pass the standards for a preliminary injunction in the first instance, it will not do so now. I would revise your estimates on the likelihood to lower than 1/2%.

Next rather than blab on BSX message board about what you don't know anything about why not put your money on the line and try this if you really believe BSX is going down April 5. Why not sell 100 contracts of BSX April 2004$40 naked calls. You collect $14,000 up front and when BSX drops $20-$25 a share you pick up another $20,000-$25,000. Be sure to confirm you have done this play so we all know you really mean what you post.
