    Should Rimm settle with NTP?

    It's nice to see Rimm had a good run in a down day. Should Rimm & NTP settle the case?<br><br>I believe NTP and Rimm will settle the case soon. Why? If they don't settle, all of them will lose.<br><br>- The best case for Rimm is they can win in the future. Even with that, it's going to take a long time. Uncertainty will hurt Rimm. By the time they win, most of the market share will be gone. What happen if the court stop them selling in U.S.?<br><br>- For NTP, they may lose the case if USPTO is not on their side. The want Rimm to prosper so that they can benefit from that. It's dangerous for them to be too greedy.<br><br>A quick settle will benefit both of them. I won't be suprised to see them settle with each other quickly.<br><br>Just a thought!

    • I don't agree with you here at all researcher. The principle behind settling sets a bad example that companies like NTP can get away with "bogus" claims. If they settle for a high amount they will face a class action law suit from the shareholders. Rimm knows this, they aren't stupid. There is no way Rimm could expect the shareholders to be happy with a billion dollar settlement when they are in a position of strength. At this point in time this case heavily favors Rimm despite what half the noobs like Lancair, wahoo,theyarestilllying say. This case is of very high importance and if there was one case the higher courts would hear, it would be this one. Its like folding a poker hand when you have a full house.

        - 'a billion dollar' settlement is certainly not a mutually acceptable settlement.

        I understand with USPTO's rejection to some of NTP claims, Rimm has good chance to win this battle. And that's what I thought, may be they can quickly work out a reasonable deal- which could be less than their previous deal.

        What I am afraid is- Even eventually Rimm is going to win this case, but Rimm could be seriously hurt by the long-term uncertainty that was created. *Rimm was the user's only choice before. But, this is not the case anymore (i.e., so many potential tough competitors).

        Principle is important, no doubt about that. The reasonable deal should also take that into consideration. Why Palm gave up their 'Principle' siding along with MSFT using MS OS? Did they give up their principle? They also have PalmOS now, although I don't know how they going to handle both in the future.

        In today's business environment, everything could happen, everything is possible. Hopefully for Rimm in this case, not only 'Operation is successful', but also 'Patient can come out even stronger'.

        Just a thought from a dum Researcher!
