    A Prediction

    Besides the obvious -- that this stock is truly a nightmare and will be worthless within months -- I am predicting the NYSE will face a front-page scandal of its own for failing to enforce its own rules (for delisting) and protect the trading public. Its slogan, "The World Puts Its Stock In Us" will become the tagline for many a joke!

    Each of us shorts has an obligation to help make this prediction come true. Write letters, contact the press, and make comments to online articles -- this is exactly what I'm doing to make sure this story is told. One or two people is not enough -- but just like in politics, if enough of us shout out, the story will be picked up and the NYSE will be doing some serious groveling in a most amusing way. I can't wait . . .

    • I strongly disagree with your prediction. The NYSE will, in fact, delist at the end of the month ... I certainly hope you're not putting a lot of money down on that bet. Cooper will point outthe ongoing investigations and get a pass.

      I strongly disagree with your prediction. The NYSE will, in fact, delist at the end of the month. The only way they could possibly justify a 3 month extension is if they have evidence the financials will be produced prior to April 30 and the company is strong. They've got nothing of the sort, and therefore, if they attempt to grant an extension, they will be skewered on the front page of the WSJ. The NYSE cannot dare to suffer such negative publicity in this day and age. Espcially over such a POS, insignificant stock.

    • As I've stated before, based on my own personal experience, restatements can be a complicated and lengthy process with a lot of going back and forth between new management and the external auditor, both of which want to cover their respective arses. If the former management team were smart, they will have already left the country because new management and the external auditor are surely going to throw them under the bus.

      I would also like to see financials sooner rather than later. It is time to wrap it up, nobody benefits from further prolonged delays in releasing the restated financials. At this point the restated financials are what will determine which direction the stock price will go. We'll see plenty of write-offs / impairments and any culpability by former management will be fully disclosed. The restated financials will serve as a basis for ALL investors to make a judgement on the value of the company's equity.

      Bankruptcy conjecture came and went. You just need to take a quick look at NYSE's inactions and past precedents to see that KKD is unlikely to be delisted unless they delay further beyond Q1.

      Expect to see restated financials released this quarter.

    • Let the financials be released and let the chips fall where they may i.e. who guessed right and who guessed wrong. If those with a bear positions feel strongly that they have indeed guessed right, then why push for delisting?

      Please no more altruistic gobelty gook.

      OK here is a prediction for Chicken Little: sometime this month there will be an article someplace somewhere that says something nice about KKD. By the way, how long is a piece of string?

      Here is some logic to ponder:

      What is the point of telling the NYSE, the SEC, or anyone else that KKD should release it's financials - it's a fundemental obligation of being a publicly traded company on a major exchange. KKD is ignoring its obligation, apparently with impunity. The NYSE can't make a company live up to the rules of the exchange, except by the threat of some sort of sanction.

      The threat of delisting is one of the few - perhaps the only - strong sanctions that the NYSE possesses. To be taken seriously (LOL) delisting has to be used when appropriate to set an example, and it is right and proper to ask NYSE to uphold its rules - and credibility.

      The motives of those calling for the rules to be upheld, whether pure or ulterior, don't really matter. What matters is that trust in the system is maintained. Who would want to invest their money in publically owned companies if there is not at least some basis to believe that one is not just handing one's money to a bunch of crooks(like KKD)?
