My point is that the plantiffs' attorneys settled for insurnace company money and as you point out this is 100% good credit as to actually receiving cash payment. I think that the possibilty of getting cash from KKD ITSELF - given the time frame of when a judgement would be received is low and that's why the ERISA suit settled for insurance company funds only. Do you think that KKD is a company that will be able to pay a large damage judgement in cash?
As far as pursuing the insurance claim in a Chapter 11, I don't think that this is a pass-through situation. My understanding is that the ERISA claim would be a general unsecured claim/judgement agaist the bankruptcy estate. I also think that any insurance company funds received could be general assets of the estate and not a pass-through to the ERISA claimants. The ERISA claimants might receive a very small percentage of their judgement.
I thought that this was the limit of the policy; but this was from memory and therefore I may be in error.

the amount is provided by the insurance company NOW if the lawyer signs onthe dotted line NOW. This is only NOW. It's transient, it's take it or leave it. Remember, this is all out-of-court. No one forced the insurance company to cover this yet, this is the deal now.
On the other hand, maybe you are right. The reason I say this is because even now that the ERISA lawyers said YES, they might still be stiffed in ch.11, it's not as if they are going to establish a lien on something as result of this resolution. So the stiffing can happen either way, right?
