    Impeachable Offense

    CBS NEWS: Official: We knew Benghazi was a terrorist attack “from the get-go.”

    But the Administration still blamed filmmaker Nakoula, who is still in jail. They did this to keep the Benghazi debacle from exploding before the election. It worked. And filmmaker Nakoula is still in jail.

    But here are some further lines of investigation. Some Obama-defenders will note that Nakoula was jailed for probation violations, of which he may have even been guilty. But, as I note in my Due Process When Everything Is A Crime piece — to be published next month, in substantially revised and updated form, by the Columbia Law Review — prosecutors can always find a reason to put someone away if they really want to. The question is, why, exactly, were they so eager to put Nakoula away?

    The fast-tracking of Nakoula’s jailing was highly irregular. Among other things, I’d like to see the Congressional investigators get Nakoula’s prosecutor, Assistant U.S. Attorney Robert Dugdale — and perhaps his boss, U.S. Attorney André Birotte Jr. — under oath about communications from the White House or the Justice Department regarding this case.

    Because what it’s looking like is that Nakoula was targeted and jailed so as to provide a scapegoat/villain in a politically motivated cover story that the White House knew was false. If that’s the case, it’s extremely serious indeed, and in some ways more significant than whatever lapses and screwups took place in Benghazi. I’d also be interested in hearing from Nakoula’s attorney, Steven Seiden, about any threats made by the government to secure a plea deal.

    If there’s an impeachable offense anywhere in the Benghazi affair it’s more likely in what happened with Nakoula than in the problems abroad, which by all appearances are simple incompetence, rather than something culpable. Railroading someone in to jail to support a political story, on the other hand, is an abuse of power and a breach of trust.

    • I'm conservative and don't like Obama's policies, but all Presidents LIE to the American people so you bunch of conservative FOOLS should know that by now and LYING to the people is not impeachable.............What is impeachable is if it turns out that he had the IRS Targeting conservatives instead of it being contained to the IRS. WE CAN NOT HAVE a government agency like that targeting people just because they want the government to Operate more efficiently with less waste!

      WE CAN NOT HAVE a government agency TARGETING ANYBODY based on skin color, sexual orientation, free speech, etc.........................This IRS targeting news scares the #$%$ out of me, and Congress needs to STOP THEM NOW AND PUT ALL INVOLVED IN JAIL!

    • Losing presidential election is tough. Losing it twice to a black guy is even tougher. Getting a beating like 332-207 is insane. Getting it when unemployment rate is 8% causes dementia.

      And that's where most of the republicans are. Did i tell that knowing that white house is beyond your reach for at least foreseeable future is even more difficult.

      Here is what sane people are thinking - The congress cut the funding for security of our embassies cos they were so worried about deficit. Did i tell you we invaded the wrong country and caused a civil war, thousands of deaths of our heroes (which obviously was not an impeachable offense!!!).

      So America knows who really caused the Benghazi. The terrorist who want to get americans and the terrorists who want to get our president out of office on any pretext.

      The good news is - THEY CAN'T!!!

    • It'd probably be wise to take a look at Nakoula's rap sheet and probation requirements. The wikipedia file on him paints a picture that makes the year of jail look entirely justified. It's possible that the wikipedia file is politically corrupted, but it's doubtful that it's that far off. If you look at Glenn Reynold's own words in the last paragraph above:

      Since you can probably throw out the claims he's making about Nakoula being unjustly imprisoned, as well, there really isn't anything left of this story worth the politically motivated attention it's getting. .
