If there were a settlement, I was thinking PAR would lowball. Do you have any idea how much damages might be (or a range), and where the settlement might occur. If there were a settlement what do you see for a range that we could expect to receive and when at the earliest and latest. Could PAR refuse to pay or get out of this, somehow?
Yes, Par will low ball any settlement offer but must weigh that against what a jury might award. No way for Par to get out of this. Since Par really scotched our highly profitable proprietary sales I think that a reasonable royalty would not be the appropriate damage award. At a minimum it should be the total of the two companies' sales plus the 90% margin plus pre and post judgment interest. Legal fees: unlikely. Jury may balk at 90% margin however. The blue sky is how much more revenue would have been generated during the period of generic sales when we discontinued sales efforts after the adverse decision.
