    The lawsuit is a cut and dry case.

    Humanscale's patent says:

    "In one embodiment of the invention, the adjustment means includes i) an extension arm fixed to the computer mouse and extending therefrom; ii) a slot in the ergonomic extension adapted to receive the extension arm for slidable movement of the extension arm therein; and iii) locking means for releasably locking the extension arm in a plurality of positions in the slot. A preferred locking means includes a protuberance on the extension arm and a plurality of notches adjacent to the slot. The protuberance engages with any of the plurality of notches to lock the extension arm in position."

    This is *precisely* the same mechanism used in the RAT mice, as you can see in this video between 0:46 and 0:48--

    • Well, well, well. This is not "precisely" the same mechanism used in the RAT. If you take a closer look at the carriage of the RAT, it is not split as Humanscale's Ergo mouse is. It is one piece with a fixed length. The 370' Patent appears to specifically state that the length adjustment is via the extension of the complete mouse which can only be accomplished by splitting the mouse in two and retaining these two pieces together.

      The RAT's are one piece, a fixed length, however length adjustment can be achieved but in a different manner when compared to the palintiff's mouse.

      There is more than one way to skin a cat. There is more that one way to make length adjustments to a mouse!

    • Does Humanscale have or did they ever make a mouse with this technology? If they didn't, they don't have a case. The patent was granted in 2000. The patent is worthless without commercial application.
