    AT&T LTSP ME

    In the AT&T LTSP, several 'custom' funds are offered and data is not publicly available because these funds 'synthesize' returns from several different institutional funds with variable weighting to each institutional fund.
    Please post the NAV's of the following 'custom' funds for each of the following dates:

    AT&T US Equity Fund

    Please also list ALL dividend dates, amounts distributed and the DRIP price on each of those dividend distribution dates for all since March 5, 2003 for both:
    AT&T US Equity Fund
    AT&T US International Equity Fund

    I desparately need the above data so as to properly value a QDRO. The former AT&T employee (my ex-wife) convinced a Judge that that her secret Pendente Lite loans (and since the divorce for all other loans my ex has taken so as to line her pocket and deplete the balance in the account) against this marital asset caused fund units to be put into an effective 'collateral' or 'margin' account, which according to my ex-wife and believed by the Court, is returned to the plan particpant whenever a repayment is made.

    The Court has ignored LTSP ME plan documentation (i.e., the SEC From 11-k, the SPD, and the SMM), which combine to depict how the pre-tax deferred investments get liquidated so as to fund the plan participant's liability (i.e., LOAN amount distributed), as well as depict how each after-tax periodic repayment is to first be applied to interest (rate depicted in loan agreement) and then to principal with investments made into fund units per the plan members' contribution/repayment choice.
    As such, the Court refuses to acknowledge how 401k loans not only recharacterize the fund units from before-tax to after-tax, but also cause the plan participant to lose their original basis (FIFO of units) of units originally purchased. The loss of this basis has materially harmed me because gains were not realized as a result of those FIFO positions being liquidated to fund those loans.

    The Court has also ignored how my ex-wife used these $35,000 of funds got via Court Order violations and not disclosed, for malicious unnecessary Pendente Lite litigation, which she started with her anti-father attorneys and lightning rod false allegation making therapist (who is before the Board of Licensing Examiners), all of whom are connected for receiving payments via Social Security Title IV-D & IV-E awards and funding (CAPTA & VAWA, as well as 'charitable' donations made to the 503C organizations).

    My ex has continued to use this 401k plan to unnecessarily maintain a liability, payments for which the court unduly excludes from her available income when calculating child support.

    Clearly this info is for justice in a legal matter to which I can't get the above data from AT&T, Fidelity, AON QDRO Dept and my vicious ex-wife. AON also refuses to acknowledge the "PLAN DOCUMENT" as well as provide historical pricing and dividend info. AON only refers to the other plan documents, all of which are not clear enough to compel the Court to see through my malicious ex-wife's obfuscation, malice and my being forced to subsidize this theft from me.

    Please help end this episode of Family Court anti-father injustice by providing the info above. The Court will be compelled under a complete QDRO valuation analsysis, but only if the data is highly accurate.

    • Thanks for the avg return data. I only need the NAV's on the dates I put in the first post for this thread. Those dates are relevant to proper valuations and harm determinations as a result of my ex-wife's liquidations used to fund the secret loans taken in violation of Court Orders, all of which she never reported (Court didn't care that ex-wife attempted such theft).

      Did I mention that the husband for my ex's attorney was also an AT&T employee. As such, my ex's attorney knew all, fraudulently argued against the truth and joined my ex in the abuse.

      Hoping none of your children have to endure what mine are with their NPD/BPD mother.
