It is litigious people like you responsible for the cost of insurance to be through the roof making it difficult to start a business in the USA. Stop your crying. If you want to go on a boat with no smoking, I suggest you buy your own.
We're not paying good money to live on a floating ashtray for 10 days. Disney parks seem pretty well managed with smoke with a couple exceptions but they should keep the smoke away from children passing through smoking areas. Universal parks were about the same but the smoking areas were much further out of the main path of the crowd, so if you didn't deliberately walk into the smokers area you don't smell it. At WDW, along the way towards Pirates of The Carribean there is a smoking area that you can't avoid as the smoking area is too close to the main travel way.
