Earnings are due out the week of the 10/24/11.
Can the company comment on the progress of the auction? Can they say the auction is going well or there are multiple companies involve in the process without giving any specific names or numbers.Or must they say, no comment until a deal is completed or taken off the table.
They already said , they are NOT, and I take them at their word, the news will be as follows:
The BOD after reviewing ????? bids , had signed a defintitive agreement to yada yada, for ____ Dollars or shares, subject to shareholder approval,
Or: <<The BOD after receiving no bids for the entire company has deemed it in the best interests of shareholders to conclude the blah blah blah and continue to execute its strategy as an independent public company.>>
Shares go straight to $35 without passing GO.
The company
does not intend to comment further regarding the review process unless a
specific transaction is approved by the Board of Directors, the review process
is concluded, or it is otherwise deemed that further disclosure is appropriate
or required by law
If the process is on going we will get an earnings release with very little comment and no CC.
They have not released an earnings date yet so that date is still very speculative.
Agreed, Boxwinner. The only possible comment will be something like:
"As we previously stated, the Company will have no comment on earnings or any other corporate developments as long as the process announced July 19, 2011 is continuing."
Not too sexy. That's why they don't pay me the big bucks to be in IR.
They probably "could". But they will not. Ambulance chasing law firms look for any excuse to initiate class actions. No sense giving them any pretext.
