STIPULATION AND ORDER OF DISMISSAL
AS TO DEFENDANT LIFE TECHNOLOGIES CORPORATION
IT IS HEREBY STIPULATED AND AGREED, by and between plaintiffs/counterclaimdefendants
Helicos Biosciences Corporation (“Helicos”) and Arizona Science and Technology
Enterprises, LLC (“AzTE”), on the one hand, and defendant/counterclaim-plaintiff Life
Technologies Corporation (“Life”), on the other hand (each a “Party,” and, collectively, the
“Parties”), through their undersigned counsel, pursuant to Federal Rule of Civil Procedure 41,
and subject to the approval of the Court, as follows:
1. All claims asserted in the above-captioned action by Helicos or AzTE against Life
shall be and hereby are dismissed in their entirety with prejudice and without costs or attorneys’
fees to any Party as against another Party.
2. All affirmative defenses and counterclaims asserted in the above-captioned action
by Life against Helicos or AzTE shall be and hereby are dismissed in their entirety without
prejudice and without costs or attorneys’ fees to any Party as against the other Party.
