      "litagation" should be spelt litigation.

      Get things right when you post. At least check your spelling!

      You are correct, the litigation may not change the stock price - but are you really that dumb?

      If zixi loses - the word will get out that they perpetrated fraud on the investors. Most of us would say that will DEFINITELY impact the stock price.

      Several of the named defendants are still with the company!

      Others were next in command e.g. Spurr etc.

      This could be a devastating blow to the corporation. It will really shake investor confidence.

      Of course, it simply reaffirms what I believe to be true -
      this stock is a sham and should be trading around $.60.

      But, let the courts settle that - I have faith in the system having been hired as an expert in two class actions suits myself.

      Here is the court order Notice it confirms my assertions - trial is set for June 2, 2008, discovery ends March 31, 2008. Dummy.


      Document 123 was jointly filed by the Plaintiffs and Defendants yesterday. The Document is a request by the parties to extend The Discovery Deadline. Main content of the Document follows:

      STIPULATION TO EXTEND DISCOVERY DEADLINE

      WHEREAS, on April 17, 2007, this Court entered a Scheduling Order that provided the following deadlines to conduct merits and expert discovery:
      i. Plaintiffs shall file a written designation of the name and address of each expert witness (other than class certification experts) who will testify at trial and shall otherwise comply with Fed. R. Civ. P. 26(a)(2) on or before November 1, 2007;
      ii. Each Defendant shall file a written designation of the name and address of each expert witness (other than class certification experts) who will testify at trial and shall otherwise comply with Fed. R. Civ. P. 26(a)(2) on or before November 30, 2007;
      iii. By December 14, 2007 all discovery, including discovery concerning expert witnesses, shall be completed;
      iv. All motions challenging or seeking to disqualify expert witnesses (other than class certification experts) (e.g. Daubert motions) and all motions that would dispose of all or any part of this case (including all motions for summary judgment) must be filed on January 18, 2008.

      WHEREAS, this Court�s April 17, 2007 order set this case for Jury trial on the Court�s three week docket beginning June 2, 2008 and also provided that the parties may agree to extend the December 14, 2007 discovery deadline, provided (i) the extension does not affect the trial date and (ii) written notice of the extension is given to the Court. Id.;
      WHEREAS, on September 26, 2007, this Court entered an order that provided for an amended briefing schedule on plaintiffs� Motion for Class Certification as follows:
      i. By December, 26, 2007, Plaintiffs shall make their supplemental class certification submissions;
      ii. By January 25, 2008, Defendants shall file their response to Plaintiffs� submission; and
      iii. By February 11, 2008, Plaintiffs shall file their reply to Defendants� submission.
      See Ct. Dkt. #122; and
      WHEREAS, the parties agree to extend the December 14, 2007 deadline and not affect the June 2, 2008, trial date, at this time;
      THEREFORE, the parties, by and through their undersigned counsel of record, hereby stipulate and agree to the extension of merits and expert discovery deadlines as follows:
      i. Plaintiffs shall file a written designation of the name and address of each expert witness (other than class certification experts) who will testify at trial and shall otherwise comply with Fed. R. Civ. P. 26(a)(2) on or before January 15, 2008;
      ii. Each Defendant shall file a written designation of the name and address of each expert witness (other than class certification experts) who will testify at trial and shall otherwise comply with Fed. R. Civ. P. 26(a)(2) on or before February 15, 2008;
      iii. By March 31, 2008, all discovery, including discovery concerning expert witnesses, shall be completed;
      iv. All motions challenging or seeking to disqualify expert witnesses (other than class certification experts) (e.g. Daubert motions) and all motions that would dispose of
      all or any part of this case (including all motions for summary judgment) must be filed on April 15, 2008.
      The parties further agree that any written designations of experts who will testify at trial and any expert reports exchanged by the parties on January 15, 2008 and February 15, 2008 will not be used in the parties� respective submissions relating to plaintiffs� Motion for Class Certification

      The way to make money on this stock is to pump and dump.

      That's the way the pros do it!

      Time now to dump.

      It will be down below $2.3 in a few weeks. Be patient.
