"The jury AWARDED Immersion damages in the amount of $82 million based on sales of infringing products through June 30, 2004."
This "award" is carried foward by the "payment" received by IMMR last week for the period from July 1st through December 31st 2004.
The nature of the 82 million is probably based on a formula or sales fiqures of the playstation containing the IMMR patented device prior to July 1st of last year.
This is my understanding and it's just as collectable as are the current payments. It's not a default "judgment" this was argued in court and Sony was the loser.
A tabaco company loses a case over a smoker who gets lung cancer and the judge "awards" the victim millions. Can be appealed. Would have to be overturned in appellate court in order for the tabaco company (Sony) to not pay the award.
I'm sure that Sony would have already filed and made public their quartely report including the sales figures for their Playstation devices for the last half of 2004. We need to just find out the particulars perhaps I'll get a reply today.
