SAN JOSE, Calif., May 18 /PRNewswire/ -- The United States Supreme Court today rejected Avant
Corporation's appeal of a Ninth Circuit Court of Appeals' decision under which Avant is enjoined from further sales of its ArcCell product line and any other products containing code copied from Cadence. Avant had asked the Supreme Court to allow it to continue selling its products even though they were found to contain code copied from Cadence. The Supreme Court rejected Avant's position without comment. The Supreme Court's rejection of Avant's appeal means that the Ninth Circuit's injunction order is now final.
The Ninth Circuit decision upheld by the Supreme Court also directed the District Court to consider Cadence's additional arguments to enjoin Avant's Aquarius product line. Cadence's request that the District Court consider additional grounds to enjoin Aquarius, based on problems with Avant's "clean room" process, remains pending before the District Court.
The District Court also has invited Cadence to submit additional evidence demonstrating that Avant's Aquarius products contain code that is substantially similar to Cadence's code. Cadence plans to submit such evidence shortly in conjunction with a new motion to enjoin Aquarius.
