The best thing Kiphart could do would be to buy out all the other shareholders. It would reduce down the liability exposure and it would give the large minority investors a way out.
The company is only in business as long as Kiphart will keep investing more money.Outside of Kiphart, the only other person who could bail out the company is Barack Obama. This is the type of money loser that Obama likes to invest in.
