    Where do you get 80% from?

    There are two possible outcomes for SJ, yes or no.

    That's 50-50. Unless you are the judge, all the legal arguments in the world don't add up to jack squat.

    He either gives a SJ or he doesn't. Everything else is conjecture.

      Not correct. The Judge makes his decision based on facts (Payne doesn't count, he isn't a real judge). We have access to most of those facts. Granted that we -- everyone -- will weigh them differently, but still, it's possible to look at the facts and make an educated guess at how the judge will rule.

      That guess is not precise, but it's a LOT better than "There are two possible outcomes for SJ, yes or no. That's 50-50".

      • So you're saying that every attorney who has ever presented a case already knows the outcome of the trial.

        Of course not. In fact very often they are surprised. There are no slam dunks.

        There are nearly just as many people who believe that SJ will not happen as there are who do. Otherwise the stock would not have achieved equilibrium so quickly.

        In fact I suspect many are betting against it, based on the stock price's behavior.

        People sell the news and buy the rumor, and yet RMBS is still a dollar plus off of its high with the rumor still intact.

        If 80% of investors felt it was SJ for certain, the stock would be at 30 right now, not 21 and change.
