There is a major error on the court and the Judges know Hynix and Micron could have appeal this case and did have a strong case for appeal. So, they start this all over again and this time do it right. JMO
ITC will make their rulings because those patents are newer patents and should not be related to the older patents on spoliation charges.
Nothing "dirty" about the patents as you imply. The issue is spoliation. One court said Rambus illegally destroyed documents. One court said Rambus did not. The CAFC will reconsider, then decide. Case law is Aptix, which said that even egregious spoliaiton (which this was not) does not rise to the level of invalidating patents. So the delay was no win for Micron/Hynix.
The ITC case involving Nvidia has nothing to do with the CAFC's delay. The ITC may rule to ban the importation of Nvidia products next month, after it too was delayed.
