IF rmbs pays $250M as ordered, they R broke: Total Cash (mrq):214.83M
So what will they do? Borrow, that good old fashioned American way or issue more stock from their treasury. The latter would be my guess since their credibility somewhat tainted by the ruling. Next question is did rmbs violate and criminal statutes by destroying the documents??
Provide a link showing that rmbs has paid anything to anyone YET(accept some lawyers) and notice the slang terms "whatever sum" & "ultimately keeps" the judge used to describe his opinion of the financial status of this case.
"The sanction will be applied against whatever sum Rambus ultimately keeps of the $349 million awarded it after a 2006 verdict finding that SK Hynix infringed Rambus patents, Whyte ruled.
The sanction “applied as a credit against Rambus’s judgment against SK Hynix recognizes that Rambus’s conduct was inexcusable but not so egregious as to justify dismissal of its infringement case,” Whyte wrote in his order today. The judge denied Hynix’s request for a new trial in the case."
So I dangerously assume you have some mathematical skill and realize this is a "0" sum event, since rmbs has already declared & it has been recorded that they had Total Cash (mrq):214.83M of which the 2006 award of $349 million was accounted for as COH, they just lost at least $250 million of their declared COH which is more than their $214.83 million in cash reported at the end of their last Q.
I think this thing gets very messy from here. rmbs has been adjudged of committing " inexcusable" conduct from a very favorable court, which any public defender grade legal beagle can hit out of Yellow Stone park. Going forward, I question rmbs will earn enough to pay their employees especially since a few of them are going to be Park Ave grade lawyers.
I don't know about all that but from the surface it will be pretty tough to spin this in a positive way UNLESS casino wall st releases a pre-dated paper showing their expectations were rmbs would have to barf up $500 million....and that is entirely possible.
