Sanctioned 250 million due to misconduct surrounding participation at JEDEC
In his 2012 opinion Whyte said it was the shredding of documents regarding participation at JEDEC which constitutes bad faith and prejudice. Is the 250 million sanction fair? The CAFC will have to come up with the answer to this as they consider this ruling along side Robinson's ruling that the same behavior justifies a sanction of unenforceability.
Whyte is now the only judge who has said despite their egregious behavior their patents are valid, so what will the CAFC say? They sided with Robinson last time!
