    FDA supplement patents

    This is a really abbreviated look at supplement patents taken from the FDA application. With the patent lawyers involved I'm sure that is a whole lot more going on.

    FDA Supplement Patents
    1- "Patent for a drug substance (active ingredient) "

    2- Patent for "A drug product (formulation and composition)"

    and/or for Method of Use
    3- 'Sponsors must submit each method of using the pending drug product for which approval is being sought"

      I am assuming ( a dangerous thing to do) that companies other than Chromadex can sell NR for the axon degeneration thing that Chromadex has the patent for but must pay Chromadex to do that.

      • No one needs to sell it for that purpose. Application patents for non novel molecules can be gone around by a first year law school student. One simply sells the molecule without claims, or with other claims. If one wishes to buy it to use for the patented application he is free to do so. If it were a new molecule the patent would be valuable, and it would be much more difficult to circumvent it. This advice comes from a very good friend who is a partner in a patent and trademark law firm. It is pretty easy to verify however.
