Looks like txcc is the only (optical/transport) chip provider that is not executing. Where other companies are. As telecoms are building out infrastrures on global basis.

They did invest in R&D in products they thought had potential, to do otherwise would have been stupid. The problem is that the macro environment determines demand. Companies like TranSwitch are way down the food chain and don't control their own fate. Your claim, as well as that of g3, of negligence doesn't hold water. JMHO.

They were negligent in not spending the R&D on products with markets and customers like other firms do -- duh !!
It is the boards job to question and second guess management. That is why I pay them
when people are being paid, to act in the best "interest" of invesotrs. where knowing thar paid(executives) are hurting the process of acting in the "best interst" of said people, or investors. Allowing the status to continue from same executives who are hurting the process of acting in "best interest" of public company. Then i do believe fraud is indeed being committed. By not making nessary replacments.
The simple answer is no, it is not fraud. The basis of fraud is deliberate deception. Incompetence or the inability to anticipate a changing economic environment is not fraud. In many ways, I think TXCC is a company that was in the wrong sector at the wrong time. I am by no means an apologist for management, but that is the way I see it.
i have legitimate question for you. If personnal on payroll who cannot execute business strategy and are not relaced for terrible their performace. But are still employed in public compamy (txcc), Is this not commiting fraud against the shareholders?
