So I'm here for the last week enjoying the beautiful skiing resort of Heavenly on Lake Tahoe with my family. While I've been busy buying 100k shares of ETAK in between runs on the chair lift I checked in on this message board on Friday to see XTJ's post on the new suit by Augme on MM. This obviously is of no surprise to since I've posted before that they indeed are an infringers of our patents. Furthermore, I believe that the actions so far by the company in bringing these new suits are indeed part of the game plan that was announced last December by the management as result of their collaborations with Ip Capital and the 2012 strategy for our IP monatization.
Not to digress, the news made me quite happy as I was riding the left up to the top of the 10k foot run with an amazing view of the Lake Tahoe....so I decided to call my wife below who apparently was enjoying the spa rather then taking advantage of the private ski lessons that I had arranged for her! Women!!! As I was giving her the news on this yet another law suite the gentleman besides me overheard my conversation. Of course my wife more interested in her spa got of the phone rather quickly to attend to more "important" business at hand. So the guy besides me turns to me and said "I'm sorry but I could not help to hear that the the company that you have invested in deals with Goodwin Proctor. Is the law suit by any chance headed by Donald Stout?".
So who was siting next to for the 10 minute long ride to the top? The law professor and the head of patent law division of UCLA! What are the chances?? So as we talked about Augme and involvement of the Don in the company he was amazed to the depth of the relationship between them. He said that Donald has developed an impressive reputation in the patent field in his ability to breakdown the technical patents so precisely that in the court of law the defendant's ability to maneuver out of it is tremendously reduced. He said that he quite regularly uses his case against RIMM in his classroom. His advise to me was that "if there is a technical infringement on a patent Don will identified it in the court of law"
Amazing run of luck huh? It sure made my vacation 100 fold better and made me forget about my wife's lavash spendings while supposedly skiing.
