    Catalysts

    Now that we, once again, ALMOST have the contract, I thought I'd start a list of things I'd like to see happening soon, and not necessarily in the order of preference.

    1) Obviously - contract dispute resolved and in production
    2) Steps to increase production capability
    3) Dengue partnership
    4) Final study enrollment
    5) Foreign orders for ST246 (does anyone use the other name; I can't even remember what it is)
    6) IND for pipeline candidates
    7) Shorts burning

    I know this isn't a comprehensive list, but it's a start.

      Can BARDA "overide" a Federal Appeals Case?????

      If they overide the GAO protest, is that the end of it??? Can the 2nd appeal still happen???

      Since Chimerix was successul in October'10....I don't think that they can be stopped from appeals. Could this still take months?????

      PLEASE ANSWER IF You KNOW!!!

      As you know, there have been similar "national interest" escape clauses in all the protested RFPs so far. And BARDA has never availed themselves of any of them. They may do so now, but I wouldn't get too hopeful of their using national interest this time, either.

      If BARDA decides to overrule the work stoppage, they can. If they think they can claim that override is "in the best interests of the United States," they can do it.

      It's in the GAO rules.

      "Agencies can, however, override stays because urgent and compelling circumstances will not permit waiting for GAO’s decision, or because performance of the contract is in the best interests of the United States. Agencies must inform GAO of their override
      decisions, but GAO cannot prevent an agency override."

    • ...I'd hate to think any of that funding could be used to appeal the GAO's ruling if decided against CMX's latest protest.

    • I know this was brought up earlier...but can BARDA review and perhaps revoke Chimerix's $75m award given their disruptive behavior wrt to delaying a national security stockpile contract for almost 2 years now.

    • It'd be nice to see some kind of sustained PR campaign kick in soon. SIGA has done a nice update of their website, which coincided with the contract announcement. My sense is that this latest stall tactic by Chimerix temporarily forces SIGA to delay post-BARDA PR plans. Once the GAO issue is dismissed (probably very soon), I suspect Rose et al will start promoting the merits of the company--to the great relief of many involved.

        Great point. I think this point has been lost amid the anxiety and noise.

        Yeah, Chimerix is doing this yet AGAIN. But this time's different. We have the ball in our court. We actually have a contract. That's new...and that's different.

        To continue the basketball analogy, it's much harder to grab a ball that's firmly in hand than to deflect a ball in play (e.g. a pass or rebound.

    • Saint....as to #6.....website chart depicts IND's are awaiting filing for 293/610 or 148/669....perhaps preclinical studies are wrapping up on these. 293 should have been done a long time ago...and 669 should need AT LEAST a few more years of preclinical studies before an IND could be filed.

      The chart is a little confusing...but it appears these drugs are thru discovery.
