These are small outfits. What is the company going to do when the big boys start selling the tests. I sold a little to soon thinking the pundits may be right about a profit decline. I guess it depends on how broadly the patents are interpreted to include design. May be a good short.
That's exactly why they're worried. Heard from a very reliable source that these small companies have already taken 15-20% marketshare with no effort. That's how hated this company is. The lawsuits I think are to scare others from launching. I can't imagine they think they can win. I've read the claims and almost all are dealing with primer and probe sequences. Problem is the supreme court ruled that if the sequence is markedly the same as found in nature then it can't be patented. Primers and probes used by these companies are identical in sequence to isolated DNA. Doesn't matter if man made or not.
