    CXW Has Serious Problems

    The Labor Department announced that the parent company of a privately run Arizona correctional facility will pay $438,600 in back pay and interest to settle the departments claim that the prison discriminated against non-Hispanic applicants in hiring correctional officers. The department's office of Federal Contract Compliance Programs had charged that Florence Correctional Center, which is owned by Corrections Corporation of America, engaged in hiring discrimination over a two year period ending in March 2006. As a federal contractor, CCA is subject to Executive Order 11246, which prohibits employment discrimination based on race, color, or national orgin. According to the OFCCP, an audit disclosed that the Florence facility disproportionately rejected non-Hispanic applicants for correctional officer jobs at the medium-security prison for male inmates. Under a conciliation agreement, CCA will pay 464 former applicants equal shares of a sum of $438,600, which represents back back pay and interest. The company also agreed to hire 16 of the previously rejected non-Hispanic applicants. The agreement provides that CCA, which is based in Nashville, Tenn., immediately will cease any discriminatory practices and undertake "extensive self-monitoring" to ensure that its hiring practices fully comply with EO 11246 and other anti-discrimination laws, the OFCCP said.
