it DOES appear, by the speed of his rebuttals, that he absolutely anticipates each of hosen's pedestrian complaints and objections, and is ready on the gun with his own. This guy is showing the judge that he is NOT a time waster, nor doing ANYTHING for the sake of padding his bill or delaying the inevitable.. It's refreshing and wonderful to watch this Susman at team work.
I think that Rosen might be trying to take on Susman personally. He has a declaration out in the WA suit involving a conversation between Susman and him about remanding the suit back to DE court. I'm not certain what Rosen's angle is, but it is certain to be weasely. Personally, I think that Susman can crush him.
Q'd, don't forget (I'm quite sure you don't) the merits of outstanding litigation vs. FDIC/JPM. If nothing else, there's at MINIMUM fruadulent conveyance. JPM makes billions per quarter of Wamu/WMB acquisition, and there are the WMI owned entities that were wrongly conveyed as well. All in all we have some outstanding litigation to go, an Examiner could not deny this IMO.
